With the rise of online shopping platforms and a growing enthusiasm for finding bargains, it is becoming increasingly difficult to differentiate between genuine and counterfeit products. While buying fake items might seem to be a way to save money,

it can have serious consequences.


Counterfeit products often fund organised crime, harm legitimate businesses and can pose health hazards. In South Africa, where online shopping is booming, as in many other countries, vigilance is essential.

 

RISKS OF COUNTERFEIT GOODS:


Counterfeit goods can pose various risks:


  • Toys:

    • Counterfeit toys can be dangerous.

    • They may contain choking hazards or harmful chemicals.

    • Local reports have highlighted unsafe toys sold at markets and online.

  • Cosmetics:

    • Fake make-up products often contain harmful substances like mercury and lead, leading to serious health issues.

  • Alcohol:

    • Counterfeit alcohol may contain dangerous substances such as methanol, posing severe health risks.

  • Electrical Goods:

    • Fake electronics can be a fire hazard or cause electric shocks.

    • There have been incidents in South Africa where counterfeit electronics have led to dangerous situations.

  • Clothing:

    • Apparel not meeting safety regulations, especially for children, can be a risk on many levels.

 

RED FLAGS:


  • Be aware of spelling errors: 

    • Spelling mistakes in product descriptions or on packaging indicate counterfeits.

    • Check the URLs of third-party sites for errors, which might signal a scam.

  • Check the packaging:

    • Genuine brands invest in high-quality packaging.

    • If the packaging is plain or poorly made, it is a red flag.

  • Compare with the manufacturer’s website: 

    • Verify the product against the manufacturer’s official website:

    • Check if the product is listed on the official site.

    • Look for design and description discrepancies.

    • Be cautious if the price is significantly lower than the standard retail price.

  • Be cautious with third-party sites: 

    • Products advertised on social media or redirected through links may not be authentic.

    • Ensure the site is reputable and you are not redirected to a questionable online marketplace.

  • Check Reviews:

    • Look for reviews from previous buyers.

    • Be wary of sites with no reviews or poor feedback.

    • Reviews provide insights into the seller's reliability.

  • Investigate the seller:

    • Research the seller’s credibility. Look for contact details and ensure the site is secure (indicated by "HTTPS").

    • Avoid sites with unclear contact information or personal email addresses.

  • Too Good to Be True:

    • If the deal seems unusually good, it might be too good to be true.

    • Always be cautious of prices that are significantly lower than average.

 

REPORTING:


If you accidentally purchase a counterfeit product, follow these steps:


  • Report it:

    • Notify the South African Consumer Commission (SACCP) or the relevant local authority about the counterfeit product.

    • If bought from an online marketplace, report the seller through the platform.

  • Know your rights:

    • You are entitled to a refund if the product is not as described.

    • Contact the seller directly to resolve the issue.

  • Dispute resolution:

    • For purchases made through platforms like Takealot or Makro, follow their dispute resolution processes.

    • For assistance with payment issues, contact your bank or payment provider.

 

Buying counterfeit products can have serious legal consequences, although the focus is generally more on the sellers and distributors than on individual buyers. 


LEGAL CONSEQUENCES FOR BUYERS:

  • Fines and Penalties:

    • Consumer Protection Act:

      • The Consumer Protection Act (CPA) protects consumers against unfair trading practices but does not explicitly penalise individual buyers for purchasing counterfeit goods.

      • If the counterfeit products cause harm or are found to be part of a broader illegal trade, buyers face legal issues indirectly.

  • Legal action by brands:

    • Civil suits:

      • Brand owners may take civil action against individuals who knowingly purchase counterfeit goods, especially if they are engaged in reselling.

      • This is more likely if there is evidence that the buyer was aware of the counterfeit nature of the products and involved in commercial activities with them.

  • Criminal charges:

    • Possession of counterfeit goods:

      • While criminal charges are more commonly directed at those who manufacture, distribute, or sell counterfeit goods, buyers can be implicated if there is evidence of involvement in a criminal enterprise.

      • For personal use, the consequences are generally less severe but could include fines or confiscation of goods.


RELATED CONSEQUENCES:

  • Seizure of goods:

    • Confiscation:

      • Counterfeit goods purchased can be seized by authorities if they are discovered during raids or inspections.

      • Buyers might lose the products and could face difficulties in recovering their money.

  • Consumer warnings: 

    • Educational measures:

      • Authorities and consumer protection agencies might issue warnings or educational notices to buyers to prevent future purchases of counterfeit goods.

  • Impact on warranties and returns: 

    • Void warranties:

      • Counterfeit products typically come with no warranty or return policy.

      • This means buyers are left with no recourse for defective products or issues arising from their use.

 

Crime begets crime -

when purposefully buying counterfeit goods, you are acting with criminal intent and supporting crime in our country.
