WHEN “ASSUMPTIONS” BECOME CRIMINAL OFFENCES


Gender-Based Violence (GBV) remains one of the most serious and pervasive crimes in South Africa.

A critical driver behind many cases is not only intent, but a fundamental misunderstanding of legal consent.


Too often, individuals rely on:

  • Assumptions.

  • Social cues.

  • Alcohol-influenced judgment.

  • Misinterpreted behaviour.


The legal system does not recognise these as valid justifications.

The result is severe: rape charges, sexual assault convictions, imprisonment, and permanent reputational destruction.

  • Sexual offences in South Africa are governed by:

    • The Criminal Law (Sexual Offences and Related Matters) Amendment Act.

  • South Africa continues to record extremely high levels of reported sexual offences annually, with thousands of rape and sexual assault cases investigated each year.

  • The law is explicit: Consent must be clear, voluntary, and ongoing.

UNDERSTANDING THE CORE LEGAL PRINCIPLE:

  • Consent is not:

    • Assumed.

    • Implied indefinitely.

    • Based on prior interaction.

    • Valid under pressure, fear, or intoxication.

  • Consent is:

    • Voluntary.

    • Informed.

    • Specific to each act.

    • Reversible at any time.

VERBAL VS IMPLIED CONSENT:

  • A common misconception is that consent can be “read” through behaviour.

  • REALITY:

    • Silence is not consent.

    • Body language is not legally reliable consent.

    • Previous intimacy does not equal current consent.

  • While consent does not have to be verbal in every instance, the absence of clear, mutual agreement creates legal risk.

  • In court, ambiguity is often interpreted against the accused.

WITHDRAWAL OF CONSENT:

  • One of the most misunderstood legal principles is that consent can be withdrawn at any time—even during the act.

  • If a person:

    • Says “stop”.

    • Physically resists.

    • Becomes unresponsive or distressed.

  • Continuing beyond that point constitutes sexual assault or rape.

  • There is no legal defence based on:

    • “It started consensually”

    • “I didn’t realise”

    • “We were already engaged”

POWER DYNAMICS: CONSENT UNDER PRESSURE

  • Consent is invalid where there is abuse of power or authority.

  • This includes:

    • Employers and employees.

    • Teachers and students.

    • Security personnel and residents.

    • Supervisors and subordinates.

  • Even without explicit threats, implied pressure can invalidate consent.

  • Courts examine:

    • Whether the individual felt free to refuse.

    • Whether there was fear of consequences.

    • Whether the authority influenced the decision.

  • In these contexts, what appears consensual may legally be classified as coercion.

FALSE ASSUMPTIONS IN SOCIAL SETTINGS:

  • SSS investigations frequently identify high-risk environments:

    • Parties and social gatherings.

    • Alcohol or drug-influenced situations.

    • Dating environments.

    • Private residences after social events.

  • Common dangerous assumptions include:

    • “They came home with me, so they consented.”

      • False. Consent to enter a space is not consent to sexual activity.

    • “They didn’t say no.”

      • Absence of refusal is not consent.

    • “They were intoxicated like me.”

      • Intoxication reduces or removes the ability to legally consent.

    • “We have history.”

      • Past consent does not apply to present situations.

CRIMINAL AND SOCIAL CONSEQUENCES:

  • Misunderstanding consent exposes individuals to:

    • Rape or sexual assault charges.

    • Arrest and criminal prosecution.

    • Inclusion on the National Register for Sex Offenders.

    • Long-term imprisonment.

    • Irreversible reputational damage.

    • Loss of employment and future opportunities.

  • These consequences are severe and permanent.

CASE-BASED REALITY:

  • Specialised Security Services has dealt with numerous cases where:

    • Individuals believed consent was implied due to prior interaction.

    • Alcohol blurred judgment and decision-making.

    • Authority figures engaged in relationships perceived as consensual.

  • In many instances:

    • Criminal cases followed.

    • Careers were destroyed.

    • Families and reputations suffered long-term damage.

  • The consistent finding: The accused misjudged consent—not the law.

PRACTICAL GUIDELINES FOR THE PUBLIC:

  • To remain within the law:

    • Ensure consent is clear and mutual.

    • When in doubt—stop immediately.

    • Never rely on assumptions or past behaviour.

    • Avoid sexual engagement where alcohol or drugs impair judgment.

    • Be especially cautious in power-imbalanced relationships.

  • The most dangerous phrase in GBV-related cases is: “I thought it was okay.”

  • The law does not operate on assumptions—it operates on evidence of consent.

  • In every case, the key question becomes: Was there clear, voluntary, and ongoing agreement?

  • If the answer is uncertain, the legal risk is extreme.

CONSENT IS NOT A GREY AREA IN LAW:

  • While social interactions may be complex, the legal standard for consent is not:

    • It must be clear.

    • It must be continuous.

    • It must be freely given.

  • Failure to understand this distinction has life-altering consequences.
