PROJECT: THE 2024 HOLIDAY SEASON (PART 3) - DRUNK DRIVING

YOU MAY SHARE THIS PUBLIC DOCUMENT

Many South African families eagerly anticipate celebrations and gatherings as the festive season approaches.

Unfortunately, this season also brings a spike in road accidents, with drunk driving posing

a serious threat to families and road users alike.

Specialised Security Services is committed to raising awareness about this critical issue and

to encourage responsible decisions to prevent avoidable tragedies.

  • According to South Africans Against Drunk Driving (SADD), alcohol abuse is responsible for over 65% of deaths and injuries on South African roads.

  • South Africa’s road death toll, averaging around 14,000 fatalities annually, is alarmingly higher than both global and African averages - a national crisis, as highlighted by the Automobile Association of South Africa (AA).

  • Drunk driving remains one of the leading causes of fatal road accidents in the country.

  • Alcohol impairs judgment, slows reaction times, and reduces focus.

  • Every year, families endure heartbreaking losses that could have been avoided by responsible choices.

LIMITS ON BLOOD ALCOHOL CONCENTRATION:

  • To safeguard road users, South African law enforces strict limits on blood alcohol concentration (BAC):

    • 0.05 grams per 100 millilitres for regular drivers

    • 0.02 grams per 100 millilitres for professional drivers

  • These limits mean that even a tiny amount of alcohol can bring drivers near or over the legal threshold.

  • Just one drink is enough to put a driver at risk of legal consequences.

CONSEQUENCES OF DRIVING UNDER THE INFLUENCE:

  • Law enforcement follows a zero-tolerance policy on drunk driving, particularly during the festive season when roadblocks and patrols increase.

  • If caught driving under the influence, offenders can expect:

    • Immediate arrest: Police will arrest drivers over the legal limit on the spot.

    • Heavy fines and legal penalties: Fines can reach up to R120,000.00 with the possibility of imprisonment.

    • License suspension: Offenders may face a license suspension, barring them from driving legally.

    • Criminal record: A conviction results in a criminal record, impacting future employment and other aspects of life.

INSURANCE IMPLICATIONS:

  • Many insurance policies include clauses that exclude coverage for incidents involving alcohol or drugs.

  • If a driver is involved in an accident and is found to have exceeded the legal alcohol limit, the insurance company may reject the claim.

  • Even small amounts of alcohol in your system could complicate or void coverage.

  • Any trace of alcohol could lead to challenges with claims, as insurers often rely on zero-tolerance clauses in their policies regarding impairment.

  • If an accident claim is filed where alcohol consumption is suspected, insurers usually conduct a thorough investigation.

  • This often involves reviewing police reports, interviewing witnesses, and gathering other evidence.

  • Should the insured driver be found to have been under the influence, insurers may deny the claim based on policy exclusions.

  • This could leave the policyholder responsible for all accident-related costs, including vehicle repairs, medical expenses, and potential third-party claims.

LEGAL CONSEQUENCES:

  • First-time offenders: If a driver’s blood alcohol level is above the legal limit (0.05 grams per 100 millilitres for standard drivers and 0.02 grams per 100 millilitres for professional drivers) but below 0.08 grams per 100 millilitres, they may face:

    • A minimum fine of R2,000.

    • Possible license suspension.

    • Jail time from two to six years in some cases.

  • Repeat or high-level offenders: If a driver exceeds a blood alcohol concentration of 0.08 grams per 100 millilitres or is a repeat offender, they face:

    • Harsher fines.

    • Extended license suspension.

    • Mandatory imprisonment.

    • A criminal record, according to the South African Police Service (SAPS).

Collective responsibility is needed to prevent drunk driving. If you see someone driving erratically,

report it immediately by calling the national emergency number, 10111.

Do not let friends or family drive under the influence. Offer alternative transportation,

arrange for a designated driver, or call a rideshare service.

If someone is about to drive while intoxicated, you have the legal right and responsibility to intervene

by taking their keys to prevent potential harm. Avoid confrontation and seek law enforcement assistance if necessary.

Specialised Security Services supports a zero-tolerance approach to drunk driving and

urges everyone to make responsible decisions this festive season.
