PROJECT: POSTING CRIME SCENE PHOTOS ON SOCIAL MEDIA - A DANGEROUS AND CRIMINAL MISTAKE

South Africa continues to face exceptionally high levels of violent crime.

According to official statistics released by the South African Police Service (SAPS), thousands of murders, attempted murders, and serious assaults are recorded every quarter. In an era dominated by instant communication, many crime scenes are photographed by bystanders and uploaded to platforms such as Facebook, WhatsApp, Instagram, and TikTok within minutes. What many citizens fail to understand is that posting crime scene photos is not only unethical — it can also be unlawful and may severely compromise criminal investigations.

INTERFERING WITH A CRIME SCENE IS A CRIMINAL OFFENCE:

  • A crime scene is a protected legal environment.

  • Only authorised officials, forensic experts, and investigating officers may document and process it.

  • When members of the public take photographs and distribute them online, several serious risks arise:

    • Evidence contamination or disturbance.

    • Alerting suspects who may not yet have been apprehended.

    • Revealing investigative techniques or positions.

    • Compromising witness safety.

  • Under South African law, interfering with a crime scene, obstructing justice, or defeating the ends of justice can result in arrest and prosecution.

  • Even the act of crossing police tape or entering a restricted area to take photographs may constitute a criminal offence.

  • Sharing such material online can further aggravate the situation.

YOU MAY BE COMMITTING A CRIME WITHOUT REALISING IT:

There are multiple legal implications when crime scene photographs are shared publicly:

1. DEFEATING OR OBSTRUCTING THE COURSE OF JUSTICE:

  • If your post compromises evidence, identifies a suspect prematurely, or influences witness testimony, you may be charged.

2. INVASION OF PRIVACY AND VIOLATION OF DIGNITY:

  • The deceased and their families have constitutional rights to dignity and privacy.

  • Graphic images may expose victims before families have been formally notified.

3. PROTECTION OF PERSONAL INFORMATION ACT (POPIA):

  • Publishing identifiable information, faces, vehicle registrations, or personal details without consent may violate the Protection of Personal Information Act.

4. CRIMINAL AND CIVIL LIABILITY:

  • Families of victims may institute civil claims for emotional distress and reputational harm. In some cases, criminal charges may also follow.

YOU TRAUMATISE FAMILIES AND THE COMMUNITY:

  • One of the most devastating consequences of posting crime scene photographs is the emotional damage inflicted on families.

  • In numerous cases across South Africa, relatives first learn of a loved one’s death through social media images rather than official SAPS notification.

  • This is not only cruel — it is deeply irresponsible.

  • The uncontrolled circulation of graphic content also contributes to community trauma, fear, and misinformation.

  • False narratives often accompany such posts, fuelling panic and, at times, even vigilantism.

YOU MAY BE ASSISTING THE PERPETRATOR:

  • In certain investigations, suspects monitor social media.

  • Posting images can:

    • Reveal whether police have identified key evidence.

    • Show what weapons or items were recovered.

    • Indicate which witnesses were present.

    • Expose police deployment patterns.

  • This information can allow perpetrators to destroy evidence, intimidate witnesses, or flee.

ETHICAL RESPONSIBILITY AND PUBLIC SAFETY:

  • As responsible citizens, we all have a duty to support law enforcement efforts and protect the integrity of investigations.

  • Crime scenes are not public spectacles.

  • They are active forensic environments where precision, confidentiality, and professionalism are essential.

  • The correct action if you encounter a crime scene is:

    • Do not approach.

    • Do not take photographs.

    • Do not share information.

    • Contact the authorities if you have relevant information.
