South Africa’s central business districts (CBDs) have increasingly become high-risk areas for violent crimes,

particularly robberies with aggravating circumstances.

These incidents often occur in broad daylight and involve unsuspecting victims.


A recent example highlights the severity of the problem: earlier this month, in the Polokwane Central Business District

in Limpopo Province, a young woman was violently attacked while on her way to a hair salon.

An unknown man suddenly confronted her, falsely accusing her of owing him money.

Before she could react, the man slapped her, forcibly took her handbag and cell phone, and fled the scene.

 

This distressing incident underscores the need for heightened public awareness, vigilance,

and understanding of the nature of aggravated robberies and how to respond to them.


Mr. Mike Bolhuis, a leading expert in safety and security in South Africa, was recently interviewed for his

insight regarding the growing trend of aggravated robberies in central business districts.

UNDERSTANDING ROBBERY WITH AGGRAVATING CIRCUMSTANCES:

  • Robbery with aggravating circumstances is one of the most serious violent crimes in South Africa.

  • It refers to the unlawful and intentional use of force to take movable, tangible property belonging to another person, under particularly dangerous or violent conditions.

  • The offence is defined under the Criminal Procedure Act 51 of 1977, while the Criminal Law Amendment Act 105 of 1997 prescribes mandatory minimum sentences for those convicted.

  • This crime falls under Schedule 5 of the Criminal Procedure Act, meaning that the burden of proof lies with the accused to show why they should be granted bail.

  • The law views this type of robbery as a grave threat to public safety, often involving elements of violence, intimidation, and severe trauma to victims.

COMMON AGGRAVATING CIRCUMSTANCES:

  • Aggravating circumstances elevate a robbery from a lesser offence to one of extreme seriousness.

  • The most common aggravating factors include:

    • USE OF A WEAPON:

      • The assailant wields a firearm, knife, or any other dangerous object to threaten or harm the victim.

    • INFLICTION OF INJURY:

      • The perpetrator causes serious bodily harm, ranging from physical assault to grievous injuries.

    • THREAT OF HARM:

      •  Even when not carried out, verbal or physical threats to inflict grievous bodily harm are sufficient to constitute aggravating circumstances.

  • These elements make the offence more severe and justify harsher penalties upon conviction.

SENTENCING AND LEGAL IMPLICATIONS:

  • Under the Criminal Law Amendment Act 105 of 1997, robbery with aggravating circumstances carries mandatory minimum sentences.

  • Depending on the severity of the case, sentences may vary:

    • 15 to 20 years’ imprisonment for first-time offenders.

    • Life imprisonment in cases involving multiple counts, fatalities, or extreme violence.

  • The courts have consistently emphasised deterrence, imposing strict sentences to address the increasing prevalence of violent robberies, especially in public spaces like CBDs.

CRIME STATISTICS:

  • According to the South African Police Service (SAPS) crime statistics for the fourth quarter of 2024/2025 (January to March 2025), there were 31,749 cases of aggravated robbery reported nationwide.

  • This reflects a 10.4% decrease compared to the same period in the previous year.

  • While this decline is encouraging, the number of incidents remains alarmingly high, especially in urban and commercial areas where foot traffic and business activity are concentrated.

HOW TO PROTECT YOURSELF FROM AGGRAVATED ROBBERY:

  • Personal safety begins with awareness and preparation.

  • Individuals must take proactive measures to reduce their vulnerability in high-risk areas.

  • AVOID THE FOLLOWING:

    • Drawing unnecessary attention by displaying expensive jewellery, handbags, or electronic devices.

    • Being distracted or unaware of your surroundings, especially while shopping, walking, or using your cellphone in public.

  • RECOMMENDED PRECAUTIONS:

    • Conduct a risk analysis before visiting a CBD or shopping area—ensure there is visible security and surveillance.

    • Inform friends or family of your movements, especially if carrying large sums of money or engaging in business transactions.

    • Maintain situational awareness while driving or parking; many robberies occur near vehicles or ATMs.

    • Remember that criminals often plan their crimes and target individuals who appear affluent or distracted.

WHAT TO DO DURING A ROBBERY:

  • In the event of an aggravated robbery, your safety is the first priority.

  • Property can be replaced—your life cannot.

  • If the assailant is armed, remain calm and compliant.

  • Address them respectfully and follow their instructions.

  • Avoid making sudden movements, eye contact, or provocative gestures that could escalate violence.

  • If the attackers are in a group or armed, do not attempt to resist.

  • Only attempt to disarm or confront a criminal if you are highly trained and physically capable, and the situation allows it.

  • After the incident, observe and recall as many details as possible (physical appearance, clothing, vehicle type, direction of escape) to assist the SAPS in compiling an accurate report.

  • Never try to be a hero—acting impulsively can result in unnecessary injury or death to yourself or innocent bystanders.

THE ROLE OF THE EYEWITNESSES:

  • Eyewitnesses play a critical role in resolving robbery cases and supporting justice.

  • Quickly assess and evaluate the situation before intervening.

  • If the suspects are armed, contact the SAPS immediately rather than confronting them.

  • Provide a detailed witness statement to the police, including descriptions, timing, and direction of escape.

  • Only intervene physically if the robber is unarmed and you are certain it is safe to do so.

  • Consider taking self-protection and situational awareness training, which can help you react appropriately in emergencies.

Aggravated robberies remain one of South Africa’s most dangerous and traumatising crimes, especially in central business districts where victims are often caught off guard. The incident in Polokwane serves as a stark reminder that criminals exploit busy environments and public distraction. By understanding the legal definitions, penalties, and preventive measures associated with these crimes, individuals can better safeguard themselves and assist law enforcement in reducing this pervasive threat.
