WHEN JUSTICE WAITS, CRIMINALS BENEFIT
Forensic DNA evidence has become one of the most powerful crime-fighting tools available to modern law enforcement.
It identifies violent offenders, links suspects to crime scenes, excludes innocent individuals, identifies unknown deceased persons, and often provides the decisive evidence that secures convictions in court.
Unfortunately, South Africa's forensic DNA system is facing one of its greatest operational crises.
Recent parliamentary disclosures have confirmed that the SAPS Forensic Science Laboratory is carrying
an enormous DNA processing backlog, with the average DNA sample waiting approximately 800 days before analysis—more than two years. Some samples have remained unprocessed for nearly three and a half years.
This is not simply an administrative inconvenience.
It is a national public safety crisis.
SSS HAS WARNED SOUTH AFRICA ABOUT THE CRISIS:
The current revelations regarding the SAPS Forensic Science Laboratory DNA backlog should not come as a surprise.
Specialised Security Services (SSS), under the leadership of Mr. Mike Bolhuis, has repeatedly warned the South African public, government, and law enforcement authorities that the country's forensic science capability was deteriorating to a point where it would eventually undermine the entire criminal justice system.
For several years, SSS has published detailed reports exposing the growing crisis within the SAPS Forensic Science Laboratories.
These reports highlighted the increasing DNA backlogs, shortages of qualified forensic analysts, ageing and unserviceable laboratory equipment, inadequate funding, procurement failures, administrative shortcomings, and the devastating consequences these failures would have for victims of violent crime.
In particular, SSS warned that:
DNA backlogs would continue to grow unless decisive intervention occurred.
Thousands of rape, murder and violent crime investigations would be delayed.
Dangerous offenders would remain at liberty while awaiting forensic results.
Victims and their families would lose confidence in the criminal justice system.
Court cases would increasingly be postponed or weakened due to unavailable forensic evidence.
The forensic crisis would ultimately become a national public safety emergency rather than merely an internal SAPS administrative problem.
Unfortunately, the situation has unfolded almost exactly as predicted.
DNA EVIDENCE SOLVES SERIOUS CRIMES:
DNA evidence plays a crucial role in investigations involving:
Murder.
Rape.
Sexual assault.
Child abuse.
Human trafficking.
Kidnapping.
Armed robbery.
Home invasions.
Cash-in-transit robberies.
Serial violent offenders.
Human remains identification.
Missing persons investigations.
Unlike eyewitness testimony, DNA evidence provides objective scientific proof that can identify perpetrators with extraordinary accuracy.
Without timely DNA analysis, many investigations simply stall.
THE CURRENT SITUATION:
According to information provided in Parliament:
Nearly 300,000 DNA samples remain within the forensic system.
Approximately 228,000 samples have exceeded the laboratory's own 90-day turnaround target.
Approximately 33,678 crime scene DNA samples remain outstanding.
Around 194,339 reference DNA samples are still awaiting completion.
Thousands of rape, murder and violent crime cases are directly affected.
The average waiting period is around 800 days, while some cases have been delayed for 1,273 days.
Every one of these samples represents a criminal investigation, a victim, and a family waiting for justice.
WHY DNA MATTERS:
Modern criminals frequently leave behind forensic evidence without realising it.
DNA may be recovered from:
Blood.
Saliva.
Hair roots.
Sweat.
Skin cells.
Cigarette butts.
Weapons.
Clothing.
Vehicles.
Fingernails.
Sexual assault evidence kits.
One DNA profile can connect a suspect to multiple offences committed across different provinces.
It can also identify serial offenders who might otherwise remain undetected for years.
THE COST OF DELAYED JUSTICE:
When DNA evidence is delayed:
Dangerous offenders remain free.
Detectives cannot finalise investigations.
Prosecutors lose valuable evidence.
Court proceedings are postponed.
Witnesses become unavailable.
Victims lose confidence in the justice system.
Families experience prolonged trauma.
Repeat offenders continue committing crimes.
In many murder and rape cases, DNA is often the strongest piece of evidence available.
Without it, successful prosecution becomes significantly more difficult.
ADMINISTRATIVE PROBLEMS HAVE SERIOUS CONSEQUENCES:
The Acting Minister of Police indicated that many delays result from incomplete or incorrectly completed documentation submitted by investigating officers, which must be corrected before laboratory processing can begin.
Because the laboratory processes samples largely on a first-in, first-out basis, these errors can delay not only individual cases but also many that follow.
While administrative accuracy is essential, the overall backlog also highlights broader challenges involving laboratory capacity, staffing, equipment, and workflow management.
CRIMINALS UNDERSTAND DELAYS:
Experienced criminals understand how overloaded criminal justice systems operate.
Every delay creates opportunities to:
Destroy evidence.
Intimidate witnesses.
Influence victims.
Relocate.
Commit additional offences.
Exploit weaknesses in prosecutions.
Delays therefore become a tactical advantage for organised crime and repeat violent offenders.
MISSING PERSONS ALSO DEPEND ON DNA:
DNA analysis is not only used to prosecute criminals.
It is essential for:
Identifying unidentified human remains.
Confirming the identities of disaster victims.
Resolving long-term missing persons investigations.
Providing closure to grieving families.
When forensic laboratories fall behind, these humanitarian functions are also delayed.
WHAT NEEDS TO HAPPEN:
South Africa urgently requires:
Increased forensic laboratory capacity.
Additional trained forensic analysts.
Modernised laboratory equipment.
Improved quality control and administrative processes.
Better training for investigating officers in evidence collection and documentation.
Faster movement of exhibits between police stations and forensic laboratories.
Greater accountability through regular public reporting on forensic turnaround times.
Strengthening forensic science is an investment in public safety, not merely an operational expense.
The strength of any criminal justice system depends not only on arrests but on the ability to secure convictions
through reliable scientific evidence.
A DNA sample sitting untested for more than two years represents far more than a laboratory statistic.
It may represent a rape survivor awaiting justice, a murder victim whose family seeks answers,
a missing person whose identity remains unknown, or a dangerous offender who continues to threaten society.
South Africa cannot afford prolonged forensic delays.
Every day that critical DNA evidence remains unprocessed is another day that justice is postponed
and public confidence in the criminal justice system is undermined.
