Specialised Security Services (SSS) expresses grave concern over the recurring failures
within the South African Police Service (SAPS).
These failures lead to the release of violent offenders owing to procedural and investigative flaws.
These systemic weaknesses erode public confidence in law enforcement and embolden criminal networks
that exploit such technical loopholes.
CASE OVERVIEW:
On 27 October 2025, eight suspects were arrested following an armed robbery at a store in Sunderland Ridge, Centurion.
The confrontation resulted in a shootout between the suspects and private security personnel, leaving one security officer and one suspect injured.
SAPS officers responded and detained all eight suspects at the scene, seizing multiple firearms, a truck used for stolen goods, and a Kia vehicle.
Despite the compelling evidence collected, which included camera footage and a vehicle with a swapped engine linked to prior ATM robberies, the suspects were released shortly thereafter.
The National Prosecuting Authority (NPA) confirmed that the case was struck from the roll at the Pretoria Magistrate’s Court on 31 October 2025 because SAPS failed to bring the suspects before court within the constitutionally mandated 48-hour period.
COMMUNITY AND INDUSTRY RESPONSE:
Private security companies and community members have reacted with alarm, describing the release as a “dangerous precedent” that undermines the rule of law.
The incident highlights a recurring pattern where solid arrests and security-led investigations collapse due to SAPS procedural errors or poor case preparation.
SSS and other crime-prevention partners have called for urgent coordination reforms between SAPS, private security, and the NPA to prevent further miscarriages of justice.
LEGAL FRAMEWORK:
THE 48-HOUR RULE:
Section 35(1)(d) of the South African Constitution mandates that any arrested individual must be brought before a court as soon as reasonably possible, but not later than 48 hours after arrest.
This safeguard prevents unlawful detention and ensures judicial oversight.
However, the rule also imposes strict procedural obligations on the police:
Delays, even if unintentional, can render a detention unlawful.
If suspects are held over weekends or public holidays, they must appear on the next available court day.
Failure to comply results in automatic release and may expose the state to civil liability.
In this case, SAPS’ inability to meet this legal requirement nullified what should have been a strong prosecution, once again demonstrating how procedural negligence undermines justice.
CAUSES OF SUSPECT RELEASE DUE TO POOR SAPS INVESTIGATIONS:
Numerous cases across South Africa reveal similar patterns of systemic breakdown in policing and investigative integrity.
Common causes include:
Insufficient or improperly collected evidence makes prosecution impossible.
Procedural breaches, such as unlawful searches, poor documentation, or missed deadlines.
Corruption and interference by officials protecting criminal syndicates or manipulating evidence.
Forensic backlogs, delaying crucial DNA and ballistic testing.
Poor command-and-control, with overburdened detectives managing hundreds of dockets each.
These failures frequently result in suspects being freed, cases being withdrawn, and victims being denied justice.
SYSTEMIC AND PROCEDURAL FAILURES IN SAPS:
The SAPS Detective Services have been identified as one of the worst-performing divisions nationally, suffering from:
A ballistics backlog exceeding 41,000 cases (as of October 2025).
Widespread corruption, including the removal or manipulation of case files.
Inadequate supervision and lack of accountability at station level.
Inconsistent forensic reporting, with documented factual errors and tampered evidence.
ILLUSTRATIVE EXAMPLES OF FLAWED INVESTIGATIONS:

The initial SAPS ballistic report was riddled with errors and was only later corrected through external intervention, revealing potential manipulation.
DJ SUMBODY AND AKA MURDER INVESTIGATIONS:
Despite firearm links through ballistics, progress has been hindered by internal dysfunction and corruption.
IVADENE LOUS CASE (GQEBERHA):
Witness statements were delayed for several days, leading to the suspect’s release on bail.
MISSING CHILDREN'S CASES:
Many cases only advance after public outcry or involvement of specialised units, exposing SAPS’ slow response.
INTERNAL CORRUPTION:
Increasing incidents of SAPS officers involved in crimes such as robbery, extortion, and kidnapping have further eroded public trust.
The Sunderland Ridge case serves as yet another critical warning about the deteriorating investigative standards within SAPS. While constitutional safeguards like the 48-hour rule protect citizens’ rights, their misuse or neglect by police officers enables criminals to escape accountability.
Specialised Security Services calls for:
Immediate national oversight of investigative standards.
Enhanced collaboration between SAPS, private security, and the NPA.
Strict accountability measures for officers whose negligence leads to case collapses.
Until systemic reform is achieved, South Africans will continue to face the reality that dangerous offenders can walk free,
not because they are innocent, but because the system has failed.
