“Specialised Services” is aware of other people who have fallen

victim to Mr. Bewsher’s ruses – we are aware of fraud to the amount of R100,000.00 at this time.

A company, whether a closed corporation or a PTY (Ltd), is seen as a judicial person.
A judicial person has legal rights of their own.
The directors or the members cannot be held personally liable for the company's debts unless they have signed a surety in their personal capacity.
When it comes to a point that the companies can no longer pay their debts, they voluntarily liquidate, or their creditors might apply for liquidation.
The assets will then be sold and should there be anything, the creditors receive it or a percentage thereof.
However, the liquidation of any company has no blot on the names of the directors or members.
This is precisely why these same people can start a new company and continue their crimes.
Such businesspeople also place their personal assets and wealth in trusts or other legal entities for exactly this reason – to prevent creditors' access to it in case of liquidation.
They might also place everything (property, houses, buildings, cars, etc) in the name of a spouse and ensure they are married out of the community of property.
Creditors or liquidators would therefore not be legally allowed to touch any of these assets.
There are only two (2) routes to counteract such people:
- A court order must approve a plea to have the director or a member of the company declared a delinquent director.
- Or if it can be proved that the directors or members knowingly sold their assets before any type of liquidation with the intent to avoid them being claimed before an inevitable liquidation.
  - This process is, however, somewhat complex and has a time limit.
  - It is also quite harrowing as the person who unwittingly bought the assets is now being persecuted to hand over something he paid for.
