PROJECT: PROPOSED ANIMAL TRANSPORT REGULATIONS UNDER DISCUSSION

New regulations governing the transport of live animals in South Africa are currently under discussion and consideration. 

These proposed measures are intended to strengthen animal welfare standards — 

particularly during long-distance and sea transport for export. It is important to clarify that this Act has not yet been published, approved, or enacted into law. 

It remains a proposed bill and policy statement that is presently being discussed and refined by those directly involved and informed within the sector. 


This revised and refurbished version reflects what is currently being proposed and suggested — 

and what needs to happen to ensure responsible, humane, and accountable animal transport practices across South Africa. 

Following careful research conducted by Specialised Security Services and industry experts, 

this proposal is supported as a necessary reform that should be implemented nationally.

WHAT IS BEING PROPOSED:

  • The proposal seeks to regulate how live animals are transported — especially sheep and cattle exported by sea.

  • If approved in future, the framework would replace the previous voluntary guidelines with mandatory legal requirements.

  • The proposed standards focus on:

    • Humane handling before transport.

    • Health and fitness checks.

    • Conditions during long-distance and sea voyages.

    • Monitoring and reporting requirements.

  • The objective is to reduce unnecessary suffering and ensure humane treatment at every stage of transport.

WHY ARE THESE CHANGES BEING SUGGESTED?

1. ANIMAL WELFARE CONCERNS:

  • Animal welfare organisations and industry specialists have raised concerns about live animal export conditions, particularly during long sea voyages.

  • Reported concerns include:

    • Overcrowding.

    • Heat stress.

    • Dehydration.

    • Limited veterinary intervention.

    • Extended journeys lasting weeks.

  • The proposed framework aims to address these risks by setting clear minimum welfare standards, should it be enacted.

2. VOLUNTARY GUIDELINES HAVE BEEN INCONSISTENT:

  • Previous transport standards have largely been advisory. 

  • This has resulted in inconsistent application and uneven compliance.

  • The proposal suggests placing new requirements formally under the Animals Protection Act (Act No. 71 of 1962), which would give them legal standing if approved.

  • At present, however, this has not yet occurred.

3. PROTECTING SOUTH AFRICA'S INTERNATIONAL REPUTATION:

  • South Africa's agricultural sector depends heavily on maintaining strong international trade relationships. 

  • Modern animal welfare standards would help:

    • Protect export markets.

    • Strengthen international trade partnerships.

    • Align with global expectations regarding humane treatment.

  • Improved standards would benefit both animal welfare and long-term economic sustainability.

HOW COULD THIS PROPOSAL AFFECT SOUTH AFRICANS:

  • If approved and implemented:

1. FARMERS AND LIVESTOCK OWNERS WOULD NEED TO:

  • Conduct proper health checks before transport.

  • Ensure only fit and healthy animals travel.

  • Reduce stress and injury risks.

  • Improve logistical planning.

  • There may be additional compliance costs such as veterinary certifications and enhanced training.

2. TRANSPORTERS AND EXPORTERS WOULD BE REQUIRED TO:

  • Use vehicles and vessels meeting welfare standards.

  • Keep detailed monitoring records.

  • Allow veterinary oversight during transport.

  • Possibly accommodate independent monitors on vessels.

  • Non-compliance could carry penalties, once and if the proposal becomes law.

3. CONSUMERS AND THE GENERAL PUBLIC:

  • The proposal would promote:

    • Greater protection of animals.

    • Increased transparency.

    • Clearer accountability within the industry.

  • Public participation and comment processes would remain important.

4. ANIMAL WELFARE ORGANISATIONS:

  • The proposed framework would provide:

    • A stronger legal basis for advocacy.

    • Measurable welfare standards.

    • Defined compliance benchmarks.

  • Some stakeholders continue to recommend that additional measures may be necessary in future.

WHY THIS MATTERS:

1. PROTECTING ANIMAL WELFARE: 

  • Animals transported over long distances — especially by sea — remain vulnerable to stress, injury, and illness.

  • Stronger enforceable standards would significantly reduce preventable suffering.

2. RAISING INDUSTRY STANDARDS:

  • Modernised regulations would promote:

    • Consistency.

    • Transparency.

    • Improved export credibility.

  • This would strengthen South Africa's agricultural standing globally.

PROPOSED MONITORING AND OVERSIGHT MEASURES:

  • If enacted, the proposal includes:

    • Daily monitoring of animal health.

    • Temperature and ammonia level measurements.

    • Veterinary oversight during journeys.

    • Mandatory post-voyage reporting.

  • These measures aim to ensure accountability from departure to destination.

NATIONAL IMPLEMENTATION RECOMMENDATION:

  • It is strongly suggested that, should this proposal be approved, it be implemented countrywide and not limited to Gauteng only.

  • Uniform national standards would prevent regulatory inconsistencies between provinces.

CLARIFICATION:


This is currently a proposed bill and discussion framework only.

It has not yet been published, approved, or enacted.

These proposals reflect what is presently being discussed and suggested by informed stakeholders within the sector

and what is considered necessary to strengthen animal welfare standards.


Following careful research by Specialised Security Services, this proposal is supported as

a responsible and necessary reform that should be implemented nationally once formally approved.

Animals deserve humane treatment from farm to final destination.

Stronger, enforceable transport standards would help ensure that.

Awareness, engagement, and informed discussion remain essential as this proposal moves through the consideration process.
