CASE BACKGROUND AND CURRENT STATUS:
The criminal case against alleged diamond investment fraudster Mr. Louis Liebenberg continues to develop,
with psychiatric observation at Weskoppies Hospital remaining a central procedural issue.
Mr. Liebenberg and his wife, Mrs. Desiree (Dezzi) Liebenberg, along with seven co-accused, face charges of fraud (alternatively theft), racketeering, money laundering, and various statutory offences, involving more than R4 billion.
The referral for psychiatric observation was ordered in August 2025 by the Bronkhorstspruit Magistrate's Court,
following Mr. Liebenberg's chaotic self-representation during bail proceedings, during which he accused the magistrate,
the prosecution, and correctional services of bullying him, rather than addressing bail issues.
HIGH COURT UPHOLDS OBSERVATION ORDER:
In February 2026, the Gauteng High Court in Pretoria dismissed Mr. Liebenberg's urgent application to overturn the psychiatric observation order.
Judge Mandla Mbongwe ruled that:
The referral was in Mr. Liebenberg's constitutional interests to be evaluated now rather than later during the trial.
The magistrate acted within the prescripts of the Criminal Procedure Act and had the discretion to refer him.
The magistrate's decision was based on her own assessment of his courtroom conduct, not solely on medical evidence.
WAITING LIST STATUS:
Weskoppies has finally confirmed that accommodation is available.
Mr. Liebenberg must report to court on 15 July.
After appearing in court, he will be escorted directly to Weskoppies by:
Colonel Danie Bruwer.
A member of the Hawks (Directorate for Priority Crime Investigation).
Attached to the Northern Cape investigation team handling the fraud case.
The availability of the psychiatric bed resolves an issue that has delayed this part of the legal process for nearly a year.
ADMISSION TO WESKOPPIES:
The court outlined strict conditions regarding his admission.
Mr. Liebenberg may:
Take only the most essential personal belongings.
Bring a valid prescription for his chronic medication.
However:
He may not take medication with him.
Medication will instead be supplied through hospital procedures.
PURPOSE OF THE PSYCHIATRIC OBSERVATION:
Once admitted:
Mr. Liebenberg is expected to remain at Weskoppies for 30 days.
The observation is intended to assess his mental condition in relation to the criminal proceedings.
The prosecution told the court:
It is uncommon for the observation period to be extended.
Although another 30-day extension is legally possible, it rarely happens.
LEGAL CONSEQUENCES OF PSYCHIATRIC FINDINGS:
The 30-day observation at Weskoppies will address two distinct legal questions under South African law: fitness to stand trial (Section 77 of the Criminal Procedure Act) and criminal responsibility at the time of the alleged offences (Section 78).
1. FOUND FIT TO STAND TRIAL:
If psychiatrists conclude that Mr. Liebenberg:
Understands the charges against him.
Understands the court process.
Can instruct his lawyers.
Can participate meaningfully in his defence.
THEN:
The criminal case proceeds normally, the psychiatric report becomes part of the court record, and the trial continues.
2. IF FOUND UNFIT TO STAND TRIAL (SECTION 77):
If psychiatrists conclude that Mr. Liebenberg cannot understand the proceedings or properly instruct his legal team:
THEN:
The trial cannot continue while he remains unfit.
Criminal proceedings are effectively paused.
The court must commit him to a psychiatric hospital or prison pending release by a judge in chambers, as Section 77(6) of the CPA is peremptory.
The court may later reassess whether he has recovered sufficiently to stand trial.
This does not mean he is innocent; it simply means the legal process cannot continue until he is capable of participating.
3. FOUND CRIMINALLY NOT RESPONSIBLE (SECTION 78):
Psychiatrists may also be asked whether, at the time of the alleged fraud, Mr. Liebenberg suffered from a mental illness preventing him from:
Appreciating that his conduct was wrong, or
Acting in accordance with that appreciation
CONSEQUENCE:
He would generally not be convicted in the ordinary sense.
He could instead be declared a state patient or dealt with under mental health legislation.
However, unlike Section 77, the court has discretion under Section 78(6) to order release on conditions or even unconditionally.
CHALLENGES FOR THE DEFENCE:
COMPLEXITY OF FINANCIAL CRIME CASES:
In large fraud cases like Mr. Liebenberg's, prosecutors typically argue that sustained planning and execution demonstrates a person who understood their actions.
The allegations involve:
Extensive business dealings.
Investment schemes.
Contracts and financial transactions.
Prolonged conduct over time.
The psychiatric observation at Weskoppies is a procedural step, not a conviction or sentence.
The outcome will determine whether Mr. Liebenberg is fit to stand trial and whether any mental disorder
may reduce his criminal responsibility. The charges do not automatically disappear—depending on the finding,
the case may continue, be delayed, or the court may order psychiatric treatment before deciding how to proceed.
The referral itself does not imply that the court believes Mr. Liebenberg is mentally unstable.
Rather, it reflects the court's assessment that sufficient reason exists to obtain an independent medical opinion to help decide his fitness to stand trial and, if relevant, whether mental illness affected his criminal responsibility.
