PROJECT: THE ROLE OF PRIVATE INVESTIGATORS AFTER SAPS INACTION (PART 1)

South Africa continues to experience extreme pressure on its policing resources.

According to official statistics released by the South African Police Service (SAPS),

thousands of serious violent crimes are reported each quarter,

including murder, rape, armed robbery, and kidnapping.

Detectives in many provinces carry excessive caseloads, often exceeding manageable investigative thresholds.

The result is a growing number of victims who experience delays in case allocation, forensic processing,

arrest procedures, and court progression.


When criminal investigations stall, victims often feel abandoned and unprotected.

However, the law does not prohibit victims from seeking lawful private investigative assistance.

  • Private Investigators in South Africa operate under regulation by the Private Security Industry Regulatory Authority (PSIRA) in terms of the Private Security Industry Regulation Act.

  • It is critical to understand:

    • Private Investigators cannot arrest suspects (unless a lawful citizen’s arrest applies under the Criminal Procedure Act).

    • They may not impersonate police officers.

    • They may not access restricted state databases.

    • They must operate strictly within the law.

  • Their function is not to replace SAPS — but to supplement investigative momentum lawfully and professionally.

WHAT PRIVATE INVESTIGATORS CAN DO AFTER SAPS DELAYS:

1. INDEPENDENT EVIDENCE COLLECTION:

  • A Private Investigator may:

    • Re-interview witnesses.

    • Identify additional witnesses overlooked.

    • Secure available CCTV footage before deletion.

    • Conduct lawful surveillance.

    • Obtain open-source intelligence (OSINT).

    • Preserve digital evidence.

  • In many cases, early intervention prevents critical evidence from disappearing.

2. CASE FILE RECONSTRUCTION:

  • Where dockets are incomplete or poorly compiled, a Private Investigator can:

    • Chronologically reconstruct events.

    • Analyse inconsistencies in statements.

    • Identify evidentiary gaps.

    • Prepare structured reports for legal representatives.

  • This often strengthens the case before prosecution.
